OUR COMMITMENT

1. Cheyson Business Services Inc. and The Service Agreement Company of Canada Inc. (“CBS”, “us” or “we”), is/are committed to maintaining the integrity and privacy of its users, including you (personally and, if applicable, on behalf of the third party for whom you are using the Site; collectively, “you”). This privacy policy explains how CBS collects, uses, shares, retains and protects Information (as hereinafter defined) that may identify you or other individuals on its website at www.protectyourvehiclecanada.com (the “Site”) in connection with your use of the products and/or services made available on the Site (the “Services”).

2. CBS only collects, uses and discloses your Information in order to develop and provide you and other CBS users with the Services you request and improve your online experience. CBS only collects, uses, discloses and stores Information as described in this privacy policy (this “Privacy Policy”).

 

YOUR ACCEPTANCE OF THIS PRIVACY POLICY

3. By either providing your Information to CBS through one of its vendors, or by requesting Services, directly or indirectly, through the Site, you signify your acceptance of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services.

4. You cannot use the Services of CBS unless you are of legal age (18 years of age or older). If you are under 18 years of age, please do not attempt to register with CBS or send any Information to CBS. If CBS learns that Information from a person under the age of 18 has been submitted to CBS or uploaded to the Site, CBS will delete the Information as soon as possible.

 

COLLECTION OF INFORMATION

5. Personal Information:

CBS collects your personal information through the Site when you choose to provide such information as identified below. When you choose to share it with CBS, CBS may retain your name, address, phone number, e-mail address, service contract number, loan number, insurance coverage, social insurance number, date of birth, vehicle information and claim or service request information. CBS also collects such information when you contact CBS with any questions, comments, requests or feedback (collectively, “Personal Information”).

 

6.Billing Information:

When you purchase Services, you may be required to provide certain information in addition to the Personal Information noted above. Such information may include a debit card number, credit card number and/or similar information (collectively, “”). All transactions are processed by third-party payment vendors. We do not collect, store, or maintain any Billing Information. Instead, it is collected and processed through said third-party vendors pursuant to the terms and conditions of their privacy policies and terms of use.

7. Other Information:

In addition to the Personal Information and the Billing Information noted above that you voluntarily provide to us, we may collect additional information (collectively, “). Such Other Information may include:

  • From Your Activity. Other Information that we automatically collect when you use the Services, such as your IP address(es), browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Site you visit, order information, and similar details concerning your use of the Services.

  • From Cookies. Other Information that we collect using “cookie” technology. Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” details about your visit. We use cookies to help us collect Other Information and to enhance your experience using the Services. 8. The type of Information we collect is dependent on the type of products and/or Services you require from us. We will limit the Information we collect to that which is necessary for us to carry out our Services.

 

HOW WE USE PERSONAL INFORMATION

9. We use Information to establish your identity, determine your eligibility for Services, and set up, manage, administer and maintain such Services. We also use Information to perform everyday business operations, including record keeping, internal reporting and communications with our customers. We employ other companies and individuals to perform functions on our behalf. Examples may include delivery services, marketing assistance, IT support and customer service. These other companies will have access to Information only as necessary to perform their functions and to the extent permitted by applicable law.

10.We may use Information to the extent that applicable law allows to respond to law enforcement requests and other legally and regulatory required inquiries and obligations.

11.In an ongoing effort to better understand our users and our Services, we might analyze Information in aggregate form in order to operate, maintain, manage, and improve the Services. This aggregate data will not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners and to other third parties for other lawful purposes.

 

PROTECTION OF PERSONAL INFORMATION

12. CBS will take all necessary and reasonable precautions to protect Information. CBS uses several manual and electronic controls to protect Information that has been entrusted to us. These controls include restricted access to our premises, through partnerships with technology providers who insure user authentication, encryption and firewall technology. CBS only allows access to Information to those employees who require it in their work. Employees who have access to Information have been trained in this area and are made aware of the responsibility they have for protecting same. Employees are required to make proper use of the manual and electronic controls available to are subject to disciplinary procedures for the unauthorized use or disclosure of Information. We do not guarantee the security or integrity of Information. We disclaim all liability for breaches of security or integrity or third-party interception in transmission. Any transmission of data by you via the Site or via communication with us is at your own risk.

 

DISCLOSURE OF PERSONAL INFORMATION

13. From time to time in the normal course of business it may be necessary for CBS to provide Information because of a business requirement or contractual obligation to a third party such as, but not limited to, a repair facility inspector, insurance insurer, legal counsel, regulator, adjuster, repairer or administrator. CBS advises each third party to whom it provides Information that we expect the third party to comply with applicable privacy laws and to take steps to protect such Information

 

RETENTION OF PERSONAL INFORMATION

14. CBS will retain Information for as long as is necessary to fulfill the purposes for which such Information was collected, or as is required by applicable law. Disposal of Information will be done in a safe and complete manner.

 

PRIVACY BREACH

15. In the unlikely event that CBS experiences an incident involving the loss of or unauthorized access to or disclosure of Information where a reasonable person would consider that there exists a real risk of significant harm as a result, CBS will comply in all respects with the applicable provisions of federal, or provincial privacy laws with regard to privacy breach notification and will take all necessary steps to reduce the risk of harm as a result of such breach.

 

ACCESSING YOUR PERSONAL INFORMATION

16. In some provinces an individual may have the right to be allowed access to his or her Information. Such access will be provided in accordance with applicable law. A request to access your Information must be submitted in writing. The written request must provide us with enough detail to understand what Information is being requested.We will require an individual to verify his or her identity before we provide access to his or her Information. If there are any reasons why access is denied the individual requesting access will be advised in writing. Should an individual demonstrate that any information held is inaccurate or incomplete CBS will make the appropriate changes to such information.

 

CHANGES TO THIS PRIVACY POLICY

17. This Privacy Policy is effective as of the date first above mentioned. We may change this Privacy Policy from time to time and will post any changes on the Site as soon as they go into effect. By accessing the Site or using the Services after we make any such changes, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
